Right to bid

Overview

This right allows certain voluntary and community organisations and parish councils to nominate an asset to be included in a 'list of assets of community value'. The local authority must identify if the asset fits the definition of being of community value, list it if it is, and maintain the list. If listed, the asset remains on the list for 5 years.

Nothing further happens until the owner of the asset wishes to sell it. At that time, unless certain circumstances exist, a moratorium period is triggered during which the asset cannot be sold. This period is intended to allow community groups the time to develop a proposal and raise the required capital to bid for the property when it comes onto the open market at the end of that period.

This right does not confer a right of first refusal or a right to buy to the community interest group, nor does it restrict the owner as to whom he can sell to or at what price.

To comply with our obligations under Part 5 of the Localism Act 2011:

1. We will consider your nominations sent via email to: communityrighttobid2.csb@buckinghamshire.gov.uk and make a decision within 8 weeks of receipt.

2. Appeals against a decision to list received from the owner within 8 weeks of the decision will be reviewed and the outcome of the review advised within 8 weeks of the appeal.

3. Should the owner still have grounds to question a decision to list, they can make an appeal via the independent First-Tier Tribunal within 28 days of notification of the internal review decision.

4. There is no right of appeal against a decision not to list the asset.

5. Publish a list of assets of community value and a list of unsuccessful community asset nominations - please follow the links below.

2019

Land at Lye Green Farm and Land at Nashleigh Farm
Date listed5th July 2019
Date removed from list and reason3rd December 2019 - Removed due to listing review

The Council considers that the current actual use of the listed land is agricultural (associated with a working farm) and that this use is not a qualifying use for section 88 purposes, i.e. it does not further the social wellbeing or social interests of the local community. The uses relied on to meet the test are, in the circumstances of this case, ancillary. The listed land therefore fails to meet the test in sections 88(1)(a) or alternatively 88(2)(a).

The Council is also satisfied that the listed land will either be redeveloped or remain in agricultural use in the future. On neither scenario would the section 88(1)(b) or alternatively 2(b) test be satisfied. All other envisaged uses are, on the evidence, unrealistic.

Nominated byBrown Not Green Chesham Ltd
Asset type and addressLand at  Lye Green Farm and Land at Nashleigh House, Lycrome Road, Chesham HP5 3LD
Reason for accepting the nominationThe Council considers that there has been significant community use of the land over the years and in the Councils opinion that use furthered the social wellbeing and social interests of the local community and that the land was of Community Value. The Council also considers that the land could continue to further the social wellbeing and social interests of the local community in the future.

5th July 201830th August 2018Lamb's Newsagents and Post Office, 36 Chalfont Road, Seer Green, Bucks HP9 2YGIn the Council's opinion, having regard to all of the circumstances of this case, the possibility of re-establishing a community use that would further the social wellbeing or social interests of the local community in the former shop/post office at a time in the next five years is not realistic.
