More detailed guidance is in Tree Preservation Orders: A Guide to the Law and Good Practice Since 1946, Chiltern District Council and its predecessors, Amersham Rural Council and Chesham Urban Council, have sought to preserve trees of important amenity value by making them the subject of a Tree Preservation Order (TPO).
If you want to lop or cut down a tree protected by a Tree Preservation Order (TPO) you would normally be required to submit an application and obtain consent from the District Council. If you cut down a tree which is protected you could face a fine of as much as £20,000 for each tree and you will also be asked to replace it.

In extreme cases, you can do emergency work on dead or dangerous trees protected by a TPO. However, it is advisable to check with the Council's Tree and Landscape Officer in Planning Services before any works are undertaken (Tel: 01494 732041 or 732031).
Trees may also be protected by conditions in planning permissions. You are advised to check with Planning Services before carrying out any work.
If you are refused consent you can appeal to the Secretary of State for the Environment, Transport & the Regions.
In a Conservation Area six weeks' written notice must be given to the District Council before any tree, not protected by a TPO, is cut down, lopped or topped. This period gives the Council an opportunity to decide whether or not to place a TPO on the tree(s) concerned.
